Terms of Use

These Terms govern your use of Pendid's English-language international website, accounts, creative workspaces, artificial-intelligence tools, image and video generation, editing features, projects, galleries, credits, subscriptions and related online services.

By creating an account, signing in, submitting a processing request, purchasing access, uploading content or otherwise using a service that adopts these Terms, you agree to be bound by them.

AI services are probabilistic. Pendid does not guarantee that an AI request will produce a specific, error-free or commercially suitable result. You are responsible for reviewing generated content before publication, sale, advertising, professional use or other reliance.
Pendid is not permanent file storage. Creative files and AI outputs can have limited retention. Current AI input and output files may be scheduled for automatic permanent deletion after approximately 24 hours unless a feature expressly states another retention period. Download and independently back up anything you need to keep.

1. About Pendid

Pendid is a browser-based creative service for digital design, content creation and AI-assisted processing. Its English-language international services are operated from Canada.

Available features can include AI chat, image generation and editing, product visuals, fashion imagery, portraits, logo concepts, image enhancement, background removal, storyboards, image-to-video generation, browser-based graphic design, video editing, project saving and related creative tools.

Pendid may update, replace or change tools, AI models, technical providers, infrastructure, output formats, workflows and service limits over time.

2. Acceptance and eligibility

If you do not agree with these Terms, do not use the services covered by them.

You must have the legal capacity required to enter into these Terms and make any applicable purchase. If you use Pendid for an organization, client or business, you represent that you have authority to act on its behalf.

3. Changes to these Terms

We may update these Terms to reflect changes in the service, technology, security requirements, commercial practices or applicable law. The current version will be published on this page with an updated revision date.

Where applicable law requires advance notice, renewed consent or another specific procedure for a material change, Pendid will follow that requirement.

4. Accounts and security

Some services require an account. You are responsible for protecting your account credentials and for reasonable activity performed through your account.

If Pendid detects suspicious behaviour, unusual access, abuse attempts or a security risk, access may be temporarily limited while the situation is reviewed.

5. Accurate information

Information provided for registration, purchases, account recovery and support should be accurate and usable. You are responsible for problems caused by incorrect contact information or loss of access to the email address associated with your account.

6. Acceptable use

You may use Pendid only for lawful and permitted purposes. You remain responsible for content you upload, create, edit, publish or otherwise use.

Prohibited conduct includes:

  • using the service for unlawful, fraudulent or deceptive activity;
  • infringing intellectual-property, privacy, publicity or other third-party rights;
  • impersonating another person or misusing another person's identity, image or information;
  • creating or distributing content whose use is prohibited by applicable law;
  • attempting unauthorized access to accounts, data, systems, servers or infrastructure;
  • circumventing technical, security, payment, plan or credit restrictions;
  • unauthorized scraping, automated extraction or robotic use;
  • creating excessive load, attacks, interference or damage to the service;
  • reselling or transferring account access where the relevant product rules prohibit it.

7. AI output limitations

Generative AI works probabilistically. Similar or even identical requests can produce different results.

Generated content can include errors, missing or added details, unrealistic elements, unintended interpretations, visual inconsistencies or results that do not match your expectations.

Paid access, a more advanced mode, higher quality or additional credits do not guarantee a particular result.

8. Image-generation and text-rendering errors

Generated text requires review. AI image systems can make spelling, lettering, spacing, typography, number and layout errors.

Image generation can also produce anatomical errors, altered faces, changed logos, moved objects, added or missing details, inaccurate colours or incomplete execution of instructions.

If exact wording, numbers, contact information, prices, legal information, product details, medical information or other precise data matter, verify them independently before use.

9. AI video generation

Video tools can process images and instructions to create motion and short video. Results depend on the source material, scene complexity, selected settings and the generative system used for the request.

Generated video can contain unexpected motion, changed faces or subjects, distorted objects, altered text or logos, continuity errors or movement that differs from the instruction.

Review important video before publication or commercial use. Concise, non-conflicting movement instructions generally provide a clearer generation target.

No result guarantee: subjective dissatisfaction with movement, style, similarity or visual quality does not by itself mean that the technical service failed when the requested processing completed successfully.

10. Unsatisfactory model output vs technical service failure

Unsatisfactory AI output

The request completed and produced an output, but the result is not satisfactory or the model interpreted the instruction imperfectly. Examples include spelling mistakes, unwanted visual changes, poor artistic fit or imperfect motion.

Technical service failure

A verifiable technical problem prevented the service from completing the processing path as intended or prevented a usable result from being delivered.

Technical incidents are evaluated using available service records and support information. Where an eligible failure is covered by an automatic credit restoration mechanism, the applicable credits may be restored through that mechanism.

11. Credits and metered usage

Some Pendid services use credits or another metered usage mechanism. The requirement can vary by operation, mode, duration, output size or other processing factors.

Review the amount displayed inside the tool before submitting a request.

Once processing has started and computing resources have been used, credits can be consumed according to the relevant tool. Subjective dissatisfaction alone does not automatically restore consumed credits.

12. Free, trial, gift and promotional access

Promotional access is optional and can change. A free account, trial, gift credit, discount or promotional benefit offered at one time does not create a permanent entitlement to receive the same benefit in the future.

Pendid may change eligibility, usage limits, included tools, duration or availability of promotional access, subject to applicable law and any commitments already made to a specific user.

Promotional credits have no cash value unless Pendid expressly states otherwise and may be subject to expiration or tool-specific restrictions.

13. Prevention of promotional and account abuse

Creating multiple accounts, manipulating device or identity controls, coordinating accounts or using technical methods to repeatedly claim one-time promotional benefits is prohibited.

When abuse is reasonably detected, Pendid may remove promotional benefits, restrict free access or review associated accounts in accordance with these Terms.

14. Paid plans and subscriptions

The applicable plan page or checkout flow describes the current price, term, included usage and relevant feature access before purchase.

A paid plan provides the benefits stated for that purchase at the time of purchase, subject to these Terms and mandatory applicable law.

If Pendid offers an automatically renewing plan, the renewal structure and applicable recurring price will be disclosed before purchase. A plan should not be assumed to auto-renew unless the checkout or plan terms say that it does.

15. Plan and credit expiry

Plans or credits can have an expiry period. Any remaining benefit after the stated period is governed by the conditions disclosed for that product or purchase and applicable law.

You are responsible for reviewing the current expiry information shown for your account.

16. Future changes to plans, prices and included usage

Pendid may change prices, usage amounts, capacities, technical limits, available modes or plan composition for future purchases.

A future pricing change does not automatically modify the terms of an earlier purchase in a manner prohibited by applicable law.

17. Payments and online purchases

Payments can be processed by third-party payment providers. You are responsible for providing accurate payment and billing information.

Before completing a purchase, the checkout or plan flow should show the relevant service, price and applicable payment terms. Mandatory non-government charges, if any, must not be hidden behind an unattainable advertised price. Applicable taxes can be added or shown as required by law.

Where applicable consumer law requires specific pre-purchase disclosures, electronic confirmation, a copy of the distance contract or cancellation information, those requirements remain applicable and are not waived by these Terms.

If a payment is charged but the purchased access is not activated as expected, contact support with enough transaction information to identify the purchase.

18. Refunds and credit restoration

Pendid provides digital services, and AI processing can incur infrastructure and processing cost when a request runs.

A change of mind, subjective dissatisfaction, ordinary generative-model error, spelling error inside generated imagery or imperfect interpretation of a prompt does not by itself guarantee a refund or restoration of consumed credits.

Duplicate charges, verifiable technical failures, failure to activate purchased access and other objectively reviewable payment or service issues can be reviewed by support.

Statutory rights are preserved. Nothing in this section removes a cancellation, refund, chargeback or other remedy that cannot legally be waived under applicable consumer-protection law.

19. User-provided content

You are responsible for text, images, video, audio, prompts, logos, trademarks, photographs of people and other content you upload or submit.

By submitting content, you represent that you have the rights, permission or other lawful basis needed for the requested processing and use.

20. Processing user content

To provide the requested service, Pendid may process, transmit, temporarily store, display and transform content as reasonably necessary for generation, editing, delivery, troubleshooting, security and support.

Some processing can use third-party technical services or infrastructure.

21. Ownership of your uploaded content

Pendid does not claim ownership of your original content merely because you upload it to the service. Rights in original user content remain with the lawful owner.

You grant Pendid the limited permission necessary to process that content for the requested service and related technical operation.

22. Intellectual-property status of AI outputs

Whether intellectual-property rights arise in an AI-assisted output can depend on the content, human contribution, applicable law and relevant third-party terms.

Pendid does not guarantee that every AI output is exclusively protectable, registrable or capable of preventing third-party use.

Pendid does not claim ownership of a lawful user's content merely because the service generated or processed it, but you remain responsible for checking rights needed for commercial publication, trademark use, printing, sale or other exploitation.

23. Possible similarity to existing works or people

Because generative systems can create unexpected similarities, an output may resemble existing works, styles, marks, people or other content. Review the result before public or commercial use.

24. Galleries, public sharing and showcase features

Private account outputs do not become public merely because they were created in Pendid.

If you deliberately use a public-sharing, showcase or publication feature, you are responsible for the content you choose to submit.

Pendid may review, approve, reject or remove submitted public content when reasonably necessary for quality, safety, legal compliance or platform integrity.

25. File retention, automatic deletion and backups

Pendid is a creative and AI processing service. It is not a permanent cloud-storage, archival, file-hosting or backup service unless a specific product expressly says otherwise.

Under the current AI workflow, uploaded AI input files and AI-generated output files can be scheduled for automatic and permanent deletion approximately 24 hours after upload, generation or registration in the system, as applicable. This can include processed versions, thumbnails, related technical files, metadata and active file links.

A particular feature may use a different retention period when that difference is clearly disclosed in the product or an applicable policy.

Download files and outputs you need before the applicable retention period ends. After deletion, recovery is not guaranteed and may be technically impossible.

Purchasing a plan or credits, maintaining an active account or seeing an item temporarily in a gallery does not create a permanent storage entitlement.

Saved projects and histories that are outside a particular 24-hour AI-file deletion window are still not guaranteed permanent archives. Retention can vary by product, security requirements and service design.

26. Third-party services and infrastructure

Pendid may use third-party AI systems, cloud infrastructure, content-delivery systems, storage, payment processors and other technical providers.

Outages, policy changes, capacity limitations or technical failures at a third-party provider can temporarily affect part of the service.

27. Changes to AI models and technical providers

Pendid may change the AI model or technical provider used by a tool to improve quality, cost, speed, reliability, safety or security.

Unless a separate product or written agreement expressly says otherwise, access to Pendid does not create a permanent right to one specific model, company or infrastructure provider.

28. Service limits and feature changes

Request limits, file sizes, text length, output quality, video duration, file formats, project limits, processing speed and other technical characteristics can vary by product, account or current system capacity.

Pendid can add, modify, replace, limit or discontinue features, subject to applicable law and any express commitment made for an active paid purchase.

29. Processing queues and completion time

Generation and processing times are estimates. Traffic, request complexity, AI-system availability and infrastructure conditions can affect completion time.

A status such as processing or queued does not guarantee completion by a specific time unless Pendid expressly provides a binding service commitment.

30. Availability, maintenance and interruptions

Pendid aims to provide a reliable service but does not guarantee uninterrupted or error-free availability. Maintenance, security work, network issues and events outside reasonable control can temporarily affect access.

31. Security and sensitive information

Pendid uses reasonable technical and organizational measures appropriate to the service, but no online system can provide absolute security.

Do not upload passwords, full payment-card details, private keys, highly confidential records, security credentials or information whose exposure could create serious harm unless a specific feature is expressly designed for that information.

32. Privacy and content relating to other people

If you upload or process a person's image, voice, personal information or other content about them, you are responsible for having the consent, authority or other lawful basis required for your use.

33. Suspension, restriction or account deactivation

Pendid may temporarily restrict or suspend access when reasonably necessary because of a material breach, promotional abuse, malicious activity, security risk, attempted circumvention, invalid payment, unlawful use or serious harm to the service or other users.

Where appropriate, the scope and duration of a restriction can depend on the severity and context of the issue, subject to applicable law.

34. Pendid intellectual property

Pendid's name, branding, original interface design, software, service structure, official content and other proprietary materials remain owned by Pendid or the relevant rights holder.

These Terms do not grant permission to copy, exploit or use those materials in a way that infringes applicable rights.

35. Limitation of liability

To the maximum extent permitted by applicable law, Pendid is not responsible for indirect, incidental, special or consequential loss arising from misuse of an output, unreviewed reliance on generated content, failure to maintain an independent backup, lost business opportunity or third-party service failure.

Nothing in these Terms excludes or limits liability or remedies that cannot legally be excluded or limited.

36. No professional advice

AI responses and outputs should not be relied on without appropriate professional review as medical, legal, financial, investment, security, engineering or other regulated or specialized professional advice.

37. Review before publication or commercial use

Before printing, advertising, selling, delivering to a client or publishing an output, review spelling, numbers, logos, product information, faces, trademarks, third-party rights and suitability for the intended use.

38. Support and technical review

Pendid support can review account, access, payment and technical-service issues. To investigate a particular request, support may ask for information such as the approximate time, affected tool, account context or transaction details.

Support cannot guarantee that a generative result will match a user's subjective preference. A difference in taste or creative expectation is not by itself evidence of technical failure.

39. Privacy

Pendid's handling of personal information is described in the Privacy Policy. The Privacy Policy forms an important part of the overall rules governing use of the international service.

40. Governing law

To the extent permitted by applicable law, these Terms and the Canadian-operated international service are governed by the laws applicable in Québec and the federal laws of Canada applicable there, without regard to conflict-of-law principles.

This choice of law does not remove mandatory consumer-protection rights or other non-waivable rights that may apply to you under the law of your place of residence.

41. Mandatory consumer rights

These Terms are intended to explain the service and allocate responsibilities, not to waive rights that applicable consumer law says cannot be waived.

Where applicable law gives a consumer specific rights regarding online or distance contracts, disclosures, cancellation, refunds, chargebacks or service delivery, those rights remain available.

42. Severability

If a provision of these Terms is found unenforceable or invalid under applicable law, it will be interpreted or limited to the extent legally possible, and the remaining provisions will continue in effect.
